Not false at all. Just because you weren'at privy to the original infraction doesn't mean it is false. Bunny started out as a pirate and was then "reformed". :P
Way back when the piracy subject at dst first started, there was a big post about a pirate site. That is when Bunny came out of the woodwork "working hard to catch the pirates". It was a ploy to take the attention off herself - to make people think she had "reformed". Bunny WAS indeed a pirate to start with. She MAY have mended her ways BUT I still wouldn't trust her.
Re: SA. The forums were dead and the gallery was full of hit and run layouts. They spent a lot of time deleting every day. Designers come and go. One day people love you the next they don't. Nancie didn't care about SA for long time. She wasn't even running the site. She let a lot of other people do the work. They all wanted to be paid. She wasn't making enough money.

Were the two items on the preview in question different? If so, I'd expect two items in the zip. Even if they weren't different I think it would have been deceiving and it's not the way to do a preview. Link please?

I agree that sometimes a designer will include an identical item more than once on a preview (like a flower or whatever) to make it more pleasing. I don't see how that's big deal.
Now, to the OP, two different items is another story. I know we don't allow this here, but maybe the designer just made a mistake on the preview? Have you contacted the designer? Designers don't always hear about customer service issues and surely she'd like a chance to make it right if it was in fact a mistake.

After the second email I sent, they were a little nicer and said they want to make sure I am 100% satisfied, and said she would email the designer to let her know that the preview was deceiving and see what she was willing to do. So I guess they were willing to work with me, but until I see at least a partial refund, i am still not totally happy.
All I wanted from this pack was the sand spills, that is it, and there was only one.

Unless it's half the size of the one shown and just duplicated to make it look wider. But then, that's easy enough to make yourself with the one spill.

Not the OP, but there are two sand spills in the preview. One is smaller than the other. It's hard to make out if they larger one is the same or not, as it's partially hidden by the wooden frames. Looking at it, I would assume that there are two spills in there.

That's called Customer Service. Looks like they read here though, doesn't it as the first time, the OP was essentially told to bug off.
To make sure I do not mislead you, I will quote what the email said...
"I am very sorry for the confusion and sorry that you are disappointed in the sand scatters. The description states that there were 24 elements and 4 papers and when I look at the zip that is what I see included. Sorry we cannot offer you a refund because you did get everything that the description states but I truly appreciate you bringing this to my attention. I will notify the designer that her preview was deceiving and hopefully this will not happen again in the future."
So what she said was technically correct, but the fact is, the preview was misleading. She has to take some responibility for that. So after the second email, I think she decided to do something, not sure what the reason for the change was. Let's see how willing they are and how quick they are to actually rectify the situation.
The fact of the matter is that there is only one scatter in the download and it is not as big as the one in the preview. the designer intentionally added TWO of them in there to make it either look bigger or make it look like there were two of them. That is intentionally misleading.

I've had that happen to me too. Or even worse, you find it's been downloaded at least 10 times or more, but they still won't take you on.

I've never had a store owner not reply. Guess I was lucky? I know that other designers haven't had replies from some of the owners that did respond to me.
Funny thing... Stacy Carlson from Gotta Pixel used to be partners with Tracy Lykins from Digital Freebies. They had a big split, with Stacy getting Tracy in trouble with Tracy's ex (copying some slander from Tracy out of a private forum and sending it on to Tracy's ex). Tracy went ballistic. Ended up not paying a bunch of designers, but she may have settled up with them all eventually. She "sold" the site to Maria LaFrance; most likely to avoid bad publicity. Then Stacy Carlson went on to grow Gotta Pixel. It was a definite popcorn kinda moment.
Bunny Cates is awesome and definitely not a pirate. sheesh some people.

What exactly do you want the designer to do to 'rectify' your made up 'problem' of there only being one sand spill in the kit? If she only made one, listed the contents of the kit correctly, what then? Would you like her to make a second one 'specially for you to dry your tears?

And the "we enjoyed your designs" is probably a form letter they sent to everyone. I applied to Darcy Baldwin's CT and got this great letter back as a sorry, I don't need you. Only to see at the end, it was the same letter she sent to everyone, as it was the preview for the font she included. The font was a nice touch, but all the sentiment of the note was lost which was kind of lame.

It's a CU pack, that's a good price for 28 CU items (if they were my style). I wouldn't pay it for PU.

That's what a lot of the "fantasy" style kits seem to be. 10 papers that are varying shades of the same color, and a bunch of stuff that someone else extracted. They buy it for $5.50, hope they can con 10 people into buying their "new kit" for $4 on sale and now they've made a profit. I can see why people would want to buy ribbons, buttons, staples, ect. as CU because IMO most of that stuff looks really cheesy when it's made digitally. But if I wanted to scrap with a photo of a bird, I'd just cut one out of a magazine.
I would agree, if everything in your kit is a picture someone else has extracted for you, then you aren't designing.
I can tell you one store owner who doesn't take the time to reply is Angie at Elemental. She is awful nasty.

I do think that those out there that just take other designers extraction and rename them and add them to a kit is not really designing.

Sounds like a case of buyer beware. You could have easily emailed the designer before your purchase for clarification on what the 24 elements were. The description says 24 elements..I don't see how that's being deceitful.

I am not necessarily MAD and fuming angry over this. I just brought it up because I wondered what others thought about this. I went off of what the preview had in it.
My biggest issue is why would a designer put 2 of the same element in a preview, hiding behind another one, but still visible? What was her motivation behind that?
Was it to make the element look like it was bigger than it was? Or was it to make it look like there were 2 of them? Or was it just pure obliviousness?
And why not specify what is in the download, ESPECIALLY when you have added 2 of the same element in the preview. Even if I had taken the time to count EACH element and paper, (which I do not feel as a customer I should have to do that), I still would have opened the download and seen the element was not how it looked in the preview, it would have looked much smaller. The customer should not have to take time to count each and every element. This is not rocket science. This could have all been avoided if she had not put 2 of the same element in there or if they had taken care of my concern in the first place.
Either way, it was misleading. THAT is what I had an issue with. If they choose to not do something to rectify how they mislead me, then that is their choice. But at least I will know how important my business is to them by what they decide to do. Still haven't heard back yet.

Like you, my assumption is that she put 2 there to make it look like there were 2, or to make it look like the sand was bigger than it actually is. Either way, it was intentional deceit.
This is completely off topic, but it drives me crazy to see a CU pack say '30 elements' when it is really 5 or recolored several times.

I downloaded Veronica Spriggs' part of the September blog train. It's really pretty, and something I'll definitely use. Haven't checked out the others yet, but hers is worth downloading.

Again, it all comes down to the preview. Either make proper previews, or list all the items. I really hate it when a designer takes the time to showcase the papers in a kit, with a separate preview, but think it's okay to have a preview of the elements all jumbled up.

It does not matter why someone is buying. Whether to design "their own kits" or to add ONE item into the kit from the pack, the preview should still be accurate. I seriously doubt that adding ONE item from a CU pack means that I am not designing my own kits, that is a huge generalization. Many of the "great" designers do that from time to time I bet.
The customer should not need to email the designer. Why create a preview that would call for additional questions? That is horrible CS and stupid on the designers part.

I never said she was intentionally trying being deceitful. I only said that it was deceitful. That is a fact. The fact is, she included 2 of the same element. It was rotated and maybe shrunk a little which unless you are looking at the raw files, looks to be a separate element or one large one. That is not what was included in the downloads. With a description of "24 elements", that is not accurate enough when you look at the preview and then the actual files in the download. That is the facts.
I only brought this up originally because I feel a lot of designers do this. And I feel it is misleading. Whatever the motivation for it, it is misleading. It is a horrible business practice to do that.
Maybe the few that are holding to the idea that it was not misleading are the ones who did it in the first place. Something to think about.

That tiny tag at the right is indeed included in the zip file? It's the only element I like, but I have to make sure the preview is not misleading before I download the kit! Should I have to email the designer?

This whole preview thing is bothering me. Packaging is such a big part of designing, we want our previews to look amazing. Say, I have 1 staple in the kit I'm previewing. Is it ok to duplicate the staple to hold something up at both ends or is that considered misleading? One of the pluses to digi-scrapping is that you CAN use items over and over again. So as long as I say in my product description that there is only 1 staple are you all going to be satisfied even though the preview might show 2? Sounds a little nit-picky to me.

Yes, I think that is fine because you have specified that in the description. I can read that there is ONE staple and thus know you have just repeated it in the preview.
My problem with the one in question was that they did not have a detailed description nor an accurate preview.

The point is, CU designers often duplicate things on their previews and honestly, I have no idea what the big deal is - you have the one sand spill, you can easily duplicate it to make it exactly like the one on the preview.

I doubt the CU designer was intentionally trying to mislead you. However, I think that the preview should show what is in the product. I also think that the description should state exactly what is in the product. That specific description is fairly lazy. The designer screwed up imo. If I were she, I'd try and make it up to you and I'd have already changed my preview and altered my description.
PS. Making your own unique sand spill requires a photo of some sand and about 30 seconds of work with a brush. Just saying.

I thought the note was actually very sweet and the majority of us would never have known it wasn't completely directed at one person, if she hadn't used it as the font preview. Honestly, I thought it was very nice of her to reply to 100+ emails and even nicer of her to throw in a freebie. It was an anecdote, nothing more.
I don't understand duplicating an item in a preview. If I'm looking at a preview and I see two staples, two sand spills, or two flowers, I expect to see that in the kit/CU pack. If you're scrapping your preview and you can't manage to make it look decent without duplicating things in the kit, maybe you need to add more to it. Unless you CLEARLY list each item in your description, I think the customer has the right to complain if two sand spills are pictured and only one is in the package. And she didn't ask for a full refund. Are you telling me your store would rather lose a customer who's willing to pay $5.50 for one item, than give her a $2.00 store credit?! Really? That's just crappy customer service, whether her complaint is legit or not.

1 - I read the description and saw "24 Elements" and looked the the description. Even if I had taken the time to count each element, which I do not feel a customer should have to do, it still would have looked like one big element. I would have opened the zip and seen it was not the same,

Why do designers do that for elements like this. Staples, brads, that kind of thing I can understand, but if there are not two and you included two, why not specify that in the description?
It is a FACT that the preview is misleading. Why argue over what is established as being fact. That is all I wanted to say. No whining or anger here, just complete awe of the stupidity of others and how resistant they are to just saying, "You know what? That was a little odd!".
Instead, I get people people making stupid comments about how I design and how much money I spend. THAT is what I would call ridiculous and completely irrelevant.
And since it is obvious that it is either the store manager or the designer making these comments, I guess I won't be getting any help from them. And now we all know how they treat their customers. Way to save a buck and provide 5 star customer service! Gold star for this store.
So as long as I say in my product description that there is only 1 staple are you all going to be satisfied even though the preview might show 2? Sounds a little nit-picky to me.

Nit picky? I don't think so. Think along the lines of any other kind of product. Say, you something online, it showed you that it had three or four of an item. You get the package in the mail and it's only got one. How mad would you be? Are you just being nit picky now?

The elements in this kit look to be the embroidered look. All of them have this look including the ears. It also looks like she has included characters in the kit based on some of the layouts.
She just has gotten a little smarter and not included them in the preview.

I guess the CT member could have included her own character images, but a couple of them have them. I am pretty sure that the mouse ears are included though. They go with the look of the kit.
I don't know anything except what I have read here and at DSA/DST. But there was one designer who seemed to make a pretty strong case because it was her item that was claimed to be stolen. If you follow this blog on a regular basis, its been talked about a lot. I don't understand why DST would hire her or how she has managed to be so heavily involved in the commnity again.

It really has nothing to do with digiland. I work in retail. If you buy a shirt, wear it out and don't like the color...you can return it. If you buy a picture frame and decide it doesn't match your house, you take it back. If you order your dinner and your steak isn't cooked the right way, you expect another steak or money off your order. Digi is the only place where once you buy your product and you open it up, if you don't like it, you're out of luck. She didn't ask for a full refund, she asked for a couple of bucks, which to me would have been well worth avoiding 4 days as the prime topic on a smack blog. It's called good customer service and it's pretty apparent at this point that 9th & Bloom doesn't have it. Honestly, if it were me, I'd dispute the charges through Paypal. If you're going to run a business, you need to learn the basic tenets of customer service. An angry customer does a lot of damage, especially for something like this that could have been handled by a $2 GC. (Or for those of you who think sand is so easy to make, take 5 mins and make her another sand spill.)

You can't compare things that are so different. Once you download the kit, you can easily make a copy of it, because it is digital. Can you do the same thing with the shirt, the frame or the steak? No, that's why you can return them!

I said my bit about Tina when it was first posted, and second posed, and probably third. I have stopped buying from her and I don't buy kits with her stuff in it. Not sure what else I can do. Every thread that was started at DST about her, even ones that didn't name her, was deleted.
It is so frustrating to me to see other people infringing on copyrights, right and left. they have gotten a little bit smarter about it since they do not include these items in the preview but the money is too good for them to stop.
Frustrating when other designers choose to not do that, being honest, and end up getting the shaft while others make good money at it.

I did download the first one that was posted in the established, the one by Wimpychompers and it has some quality issues. The deer is jagged and blurry and the snowman has jaggies and a black line around the bottom. I won't name all the issues, you get the point.
Not picking a fight, but i think its interesting that every kit you linked I really dislike, with the possible exception of the Project B one. Just shows you how we are all looking for different things.

Sure it's different. Even if every other kit there is boring, I would never use that kit. It's blurry, the colors all wash into each other, there is no depth on the elements. My 12 year old could hand paint better than that - its muddy and ugly.

No, its not the point. I think the designers who have some proven longevity and really good sales have gotten to that point through hard work and paying their dues. None of them were just out for the quick buck and they have worked over the course of years to get to where they are.
It makes you look really bad when you can't sit still long enough to develop a loyal following. Those are the people who seem to be in it just for the quick buck and I don't have respect for that. When I see that sort of behavior, I spend my money elsewhere. Food for thought.

Dig in, really work to promote yourself and your store, build a following, and then when you are known you can apply to any store you want. Wow, those present boxes are identical! I understand that there's only so much you can do with a present box, but those are near exact copies.
I'd like to see a larger version of the Ikea image to compare them a bit closer. I do see that the bird, large flower and tulip spray look very similar, but I'd still like to see close up before making a final judgement. I'm inclined to believe she's as guilty as hell though.

Wheres the proof of that though ? If I can be 100% certain with my own eyes, it doesnt matter what people will say about Ikea.

It makes you look really bad when you can't sit still long enough to develop a loyal following. Those are the people who seem to be in it just for the quick buck and I don't have respect for that. When I see that sort of behavior, I spend my money elsewhere. Food for thought.
I totally agree with this. It makes you look fickle and hard to please when you move around like that. Dig in, really work to promote yourself and your store, build a following, and then when you are known you can apply to any store you want. Designers are totally shooting themselves in the foot with all the store hopping.

The entire point of selling is to SELL. If a designer is at a store without a customer base or without one that responds to their products, then the designer is supposed to stay and continue to make products that don't sell there JUST so they don't store hop? I think that advice is beyond poor business; it's plain stupidity.
And to not have respect for a designer who is thinking about their business is way beyond stupid. In an industry filled with bored housewives who are content to make $60/month, I have nothing but respect for the women who take their business seriously enough to say, "I deserve better than that." Those are the designers who get my money - whether they store hop or not. Because those are the designers who are digging in their heals and making the commitment to be a designer longer than 6 months.
In fact, I look at the stores they hop from. If a bunch of designers leave the same stores within a few months, to me, that says there is something wrong with the store. Look at ES' big debacle. Someone mentioned Scrapable - what a mess that store is. You're going to fault designers who leave stores that make bad business decisions? stores who break contracts? stores that can't keep an owner longer than 6 months? owners who steal?
A following will come when you find an honest, stable store with CUSTOMERS who like what you offer. This isn't always easy to know without jumping in and trying a store. Most of these smaller stores are only proving grounds for larger stores anyway. That's their role whether they like it or not.
Any designer who can't recognize that needs a clue - and a career change.

There's a difference between good business decisions and not. Store hopping a lot is not a good business decision. Seeing as someone made a reference to a 'real' job, let's be honest, in the real world, an employer is not going to take you on if you've had a bunch of jobs in a short period of time. It makes you look flaky and unreliable.
I'm not going to shop with a designer that has store hopped, meaning, 4 or more stores in an eight month period. That is store hopping. Changing a store once or twice in a year is hugely different.
Some of you obviously can't see that. Unwad your indignation for a second, and take the time to think about what is being said.
Because those are the designers who are digging in their heals and making the commitment to be a designer longer than 6 months.

It's not much of a commitment if they've been to two or more stores in a six month period. Geez, that's hardly long enough to have anyone find you, much less develop a customer base. Any designer that has moved stores more than once in six months, and does it often, is not going to get my business.

No one is talking about designers who leave in circumstances like that. I do believe we are talking about designers who change stores every four months or so.

Well, since you mentioned the real world job, lets look at that. One of the things employers look at on resumes is longevity and loyalty. High paying employers don't hire people who have a new job every 3 months. It just isn't worth it to them to spend the time and money training and settling in someone who clearly doesn't understand perseverance.
I'm not talking about designers who leave because of some owner change or policy change, I'm talking about designers who flit about every 2 to 3 months. They get over the rush of being the 'new designer' (where there is increased sales) and they don't know what to do with the next stage of being there, when they aren't new and exciting anymore and they need to do extra work to get the same sales.
Can you think of any designers who made a name for themselves by moving stores every 2 or 3 months? I can't.
I'll agree that smaller stores are stepping stones to bigger ones (as someone said 'proving grounds') but you still need to step carefully and make each change count.
Many of the moves these designers do aren't even up, they are sideways. They aren't moving up, they are just moving.
OK, so I found a freebie blog "scrap elements by Lena" but there's no TOU in the downloads. Really cute stuff. But it makes me wonder, is this pirated stuff?
It looks suspicious to me. At the very least there is clipart there that should be in a credits file, if she has permission to use them.

The first one on top has a lot of elements made by Americo who make layered element templates. But the Blues Clues is definitely not something that would be ok to use. That goes along with the whole copyrighted stuff.

Edeline is a total flake. She is the biggest store-hopper ever. Her designs either don't "fit" anywhere OR she doesn't stay in one place long enough to get a following. If she doesn't make "big money" within a couple of weeks she starts looking for another store. I wonder how long it will be before she's back looking for a new digi store after she doesn't make big money within 2 weeks in the paper world. LOL

I agree with the comment about Edeline Marta being the biggest store hopper ever! If I was a store owner I wouldn't want her in my shop. It would be a waste of time to set up a store for her knowing that she would leave in a few weeks. And I don't understand how she thinks. She must spend 90% of her time remaking all her previews and just 10% designing.
Remaking previews (re-uploading and addind product descriptions to the store) is such a pain in the ass.

I just looked through her gallery too. Tons of kids photos ... different kids. Are those all hers? If not, you're right. I didn't see any credit for the pics, yet she's whining about not getting credit. Wow karma - so true.
Whether or not she was credited, the mag did publish those layouts without permission but that makes me wonder about another question. Can you publish your layout in a mag if you don't have permission for the stock photo that was used?
